Moore Blatch were instructed in connection with a fatal accident case. Our client’s wife was tragically killed in a road traffic accident, leaving behind three young children.
Our client’s youngest child was also injured in the collision sustaining a fracture of the left humerus, an injury to her left little finger, lacerations to her arms and legs and severe psychological disturbance.
At the time of the accident our client was separated from his wife and she was living with a new partner and her three children. Her partner was driving the car at the time of the collision. He drove too fast and lost control of the car colliding with a tree.
Our client’s wife was killed at the scene.
The driver of the vehicle was not insured however our client’s wife had given him permission to drive her vehicle.
Moore Blatch made a claim under the Fatal Accidents Act 1976 for the children’s loss of their mother’s services as a carer and for loss of dependency on her income.
It was a complex case and there were many technical difficulties involved.
The claim settled for a six figure sum. The damages were paid into the Court Funds Office to be released to each of the children upon their attaining majority.
