On 4 April 2018 HMRC published a bulletin regarding EMI option plans, which bears a significant impact on companies proposing to grant EMI options in the near future.
The EMI tax regime is subject to EU State Aid Approval Rules, and at present – although the government have followed the process for applying to the European Commission for approval to extend the provision of EMI tax relief beyond 2018, the Commission’s final response has not get been given.
This is pertinent to companies who are planning to grant options under this scheme, because the EU State Aid approval for the EMI regime expired 3 days ago on 6 April 2018.
